These Terms of Service (“Agreement”) constitute a legally binding agreement between Caribbean Music Hub(“Company,” “we,” “us,” or “our”) and any individual, artist, organization, or entity (“User,” “you,” or “your”) accessing or using the Caribbean Music Hub website, platform, applications, and related services (collectively, the “Services”).

By accessing, registering for, uploading content to, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any portion of this Agreement, you must discontinue use of the Services immediately.

PURPOSE OF THE PLATFORM

Caribbean Music Hub is a digital music discovery and artist showcase platform designed to connect Caribbean artists, music creators, industry professionals, DJs, and listeners worldwide.

The Services may include, but are not limited to:

  • Artist profile creation
  • Music submission and showcasing
  • Promotional opportunities
  • Featured artist placements
  • Music charts and rankings
  • Marketing and promotional services
  • Subscription-based artist services
  • Community engagement features

Caribbean Music Hub operates as a promotional and discovery platform and does not guarantee commercial success, increased streams, record contracts, or financial results.

ELIGIBILITY AND USER RESPONSIBILITIES

By using the Services, you represent and warrant that:

  • You are at least eighteen (18) years of age, or have obtained appropriate parental or legal authorization.
  • All information provided is accurate, complete, and current.
  • You have the legal capacity and authority to enter into this Agreement.
  • Your use of the platform complies with all applicable laws and regulations.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities conducted through your account.

ARTIST ACCOUNTS AND SUBMISSIONS

Artists submitting music, artwork, photographs, videos, biographies, or other materials (“Content”) agree that all submitted information must be truthful and accurate.

Artists acknowledge and agree that:

  • They own or possess all necessary rights, licenses, permissions, and approvals relating to submitted Content.
  • They are solely responsible for obtaining clearance for samples, compositions, recordings, artwork, and other third-party materials.
  • They will not submit Content that infringes upon any copyright, trademark, privacy right, publicity right, or other intellectual property right.

Caribbean Music Hub reserves the right, at its sole discretion, to refuse, remove, restrict, or disable access to any Content that violates these Terms.

OWNERSHIP AND LICENSE RIGHTS

Artists retain all ownership rights, including copyrights and intellectual property rights, in their original music and creative works.

By submitting Content to Caribbean Music Hub, you grant the Company a worldwide, non-exclusive, royalty-free license to:

  • Host, display, reproduce, and distribute submitted Content through the Services.
  • Promote artists, releases, and platform features.
  • Include Content in playlists, charts, promotional materials, newsletters, social media posts, and marketing campaigns.
  • Use artist names, images, logos, and promotional materials solely for platform-related purposes.

This license does not transfer ownership of the artist’s intellectual property to Caribbean Music Hub.

COPYRIGHT AND INTELLECTUAL PROPERTY POLICY

Caribbean Music Hub respects intellectual property rights and expects all users to do the same.

Any claim that uploaded Content infringes upon copyright or intellectual property rights may result in removal of the Content, suspension of the account, or termination of access.

Users submitting unauthorized material may be held responsible for all damages, claims, legal fees, and expenses arising from such violations.

PROMOTIONAL SERVICES AND FEATURED PLACEMENTS

Caribbean Music Hub may offer paid promotional opportunities, including:

  • Featured song placements
  • Artist spotlight features
  • Homepage promotion
  • Social media promotion
  • Newsletter placements
  • Chart consideration

Purchasing promotional services does not guarantee:

  • Increased listeners
  • Increased followers
  • Streaming success
  • Sales
  • Industry opportunities

All promotional decisions remain at the discretion of Caribbean Music Hub.

PAYMENTS, SUBSCRIPTIONS, AND REFUNDS

Certain Services may require payment, including artist memberships, promotional packages, or premium features.

By purchasing any paid Service, you agree that:

  • All payment information provided is accurate and authorized.
  • Fees are payable according to the pricing displayed at the time of purchase.
  • Subscription services may automatically renew unless cancelled.
  • Payments are non-refundable unless required by applicable law or expressly stated otherwise.

Caribbean Music Hub reserves the right to modify pricing, features, and subscription offerings at any time.

USER CONDUCT

Users agree not to:

  • Upload unlawful, defamatory, abusive, or misleading material.
  • Impersonate another artist, individual, or organization.
  • Manipulate votes, rankings, charts, or engagement systems.
  • Attempt unauthorized access to the platform.
  • Use the Services for fraudulent, harmful, or illegal activities.

Violation of these provisions may result in immediate account termination.

MUSIC CHARTS AND RANKINGS

Caribbean Music Hub charts, rankings, and featured selections may be determined based on factors including:

  • Listener engagement
  • User interaction
  • Platform activity
  • Editorial review
  • Promotional campaigns
  • Industry trends

Chart placements are not guaranteed and do not constitute certification, awards, or official recognition.

THIRD-PARTY SERVICES

The Services may contain links or integrations with third-party websites, streaming platforms, payment processors, and social media services.

Caribbean Music Hub does not control and is not responsible for:

  • Third-party content
  • Privacy practices
  • Terms of service
  • Availability of external services

Users access third-party services at their own risk.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, Caribbean Music Hub shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from:

  • Use or inability to use the Services.
  • Loss of music, data, revenue, or opportunities.
  • Unauthorized access to accounts.
  • Third-party claims or disputes.

The platform is provided on an “as available” and “as is” basis without warranties of any kind.

INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Caribbean Music Hub, its owners, employees, affiliates, partners, and representatives from any claims, damages, liabilities, expenses, or legal costs arising from:

  • Your use of the Services.
  • Your submitted Content.
  • Your violation of this Agreement.
  • Your infringement of third-party rights.

TERMINATION OF SERVICES

Caribbean Music Hub reserves the right to suspend or terminate accounts, remove Content, or restrict access to the Services at any time if:

  • These Terms are violated.
  • The platform is abused.
  • Content creates legal risk.
  • The Company determines termination is necessary to protect the platform or community.

CHANGES TO THIS AGREEMENT

Caribbean Music Hub reserves the right to modify these Terms of Service at any time.

Updated Terms will become effective upon publication. Continued use of the Services following changes constitutes acceptance of the revised Agreement.

GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with applicable laws governing the jurisdiction in which Caribbean Music Hub operates, without regard to conflict of law principles.
